| There have been various changes in Florida law over the last few years, particularly regarding the Durable Power of Attorney, Living Will and Designation of Health Care Surrogate. If your last Durable Power of Attorney was executed before 1995, it should be redone. Hospitals and doctors are requiring the Designation of Health Care Surrogate to be properly prepared, including important HIPAA compliant language. New requirements have been approved for the Living Will. There was also a change in Florida law regarding Estates. If a husband and wife own real estate in both names and one spouse died on or after January 1, 2000, there are new requirements in order to clear title.
